  By posting communications on or through this Site, End User shall be deemed to have granted to BeStylish a royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, publish, edit, translate, distribute, perform, and display the communication alone or as part of other works in any form, media, or technology whether now known or hereafter developed, and to sublicense such rights through multiple tiers of sub-licensees.

  Credit card information will be masked on your account and will not be visible to BeStylish Customer Service operators.
  
  You agree, understand and confirm that the credit card details provided by you for availing of services on BeStylish will be correct and accurate and you shall not use the credit card which is un-lawfully owned by you, thus you must not pay or attempt to pay for Product(s) using fraudulent credit card information. You further agree and undertake to provide the correct and valid credit card details to BeStylish.In case of orders that amount to Rs. 10,000 or more, the customer will be required to provide the last four digits of the credit card used to place the order, for the purpose of verification.
  
  Further the said information will not be utilized and shared by BeStylish with any third parties unless required for fraud verifications or by law, regulation or court order. BeStylish will not be liable for any credit card fraud. The liability for use of a card fraudulently will be on you and the onus to ‘prove otherwise’ shall be exclusively yours.
  
  We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.

  In our endeavor to make shopping on our website a satisfying experience, beStylish provides customers with the 'Reward Points' system that lets you earn as you shop.
  
  • (i) Each point is equal to one rupee (1 point = Rs. 1)
  • (ii) To begin redeeming, a user must have accumulated a minimum of 500 points.
  • (iii) Reward points have a validity of 180 days or six months.


• Pricing Information
  
  We strive to provide you with the best prices possible on Product(s) you buy from BeStylish, however, BeStylish does not guarantee that the price will be the lowest in the city, region or geography. Prices and availability are subject to change without notice.
  
  While BeStylish strives to provide accurate Product and pricing information, pricing or typographical errors may occur. In the event that a Product is listed at an incorrect price or with incorrect information due to an error in pricing or Product information, BeStylish may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. BeStylish will have the right to modify the price of the Product and contact you for further instructions using the e-mail address provided by you during the time of registration, or cancel the order and notify you of such cancellation. In the event that BeStylish accepts your order the same shall be debited to your credit card account. The payment may be processed prior to BeStylish dispatch of the Product that you have ordered. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to your credit card account.
  
  
• Cancellation by BeStylish
  
  Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in Product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will contact you (by email/ phone) and inform in case your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your credit card has been charged, the said amount will be reversed back in your Card Account. In case your number is part of DNC (Do Not Call) list generated by TRAI (Telecom Regulatory Authority of India) then we will not able to contact you but would be sending email notification for same.   In case of pre-paid order due to non -confirmation of payment from your bank within 30 minutes, your order would be automatically cancelled. If payment is received at later stage then a new order will be placed by Bestylish team on your behalf subject to product availability.
  
  
• Cancellations by the Customer
  
  In case of requests for order cancellations, BeStylish reserves the right to accept or reject requests for order cancellations for any reason. As part of usual business practice, if we receive a cancellation notice and the order has not been processed / approved by us, we shall cancel the order and refund the entire amount. We will not be able to cancel orders that have already been processed. For cancellation of orders that have been dispatched please refer to our Returns section below. BeStylish has the full right to decide whether an order has been processed or not. The customer agrees not to dispute the decision made by BeStylish and accept BeStylish’s decision regarding the cancellati on. BeStylish also reserves the right to cancel your order in case of:

• Indemnity
  
  You agree to indemnify and hold BeStylish (and its officers, directors, agents, subsidiaries, joint ventures, and employees) harmless from any claim or demand, including reasonable attorneys’ fees, or arising out of or related to your breach of this T&C, or your violation of any law or the rights of a third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfillment of any of your obligations under this End User Agreement or arising out of violation of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. This clause shall survive the expiry or termination of this T&C.
  
  
• Severability
  
  If any of the Terms shall be deemed void, invalid or unenforceable for any reason, that condition shall be deemed several and shall not affect the enforceability of any remaining provision.
  
  
• Customer Communication
  
  BeStylish will communicate with you about your order and the purchased Product through any of the mode using email, SMS and telephone or all of them or any other mode. Account holders must provide a valid email address and contact telephone and/ or mobile number to BeStylish for this purpose.
  
  Please note Bestylish will not be able to contact the customer in case customer’s number is part of DNC (Do Not Call) list as generated by TRAI (Telecom Regulatory Authority of India). In this case we request customers to call us on our call center number 1800-4190300.
  
  In case of Cash-On-Delivery orders, customers will receive a confirmatory call by customer care. Only then will their order be sent for processing. In case of failure of confirmation of order after four attempts, the order will be cancelled and email notifying cancellation will be sent to the customer. In case your number is on DNC (Do Not Call) list by TRAI (Telecom Regulatory Authority of India) you are requested to contact us at 1800-4190300 for the confirmation of the order. Order will not be processed till successfully confirmed. Please note order not confirmed within 48 hours will be cancelled.

  • (v) Messages by non-spokesperson employees of BeStylish purporting to speak on behalf of BeStylish or containing confidential information or expressing opinions concerning BeStylish.
  • (vi) Messages that offer unauthorized downloads of any copyrighted or private information.
  • (vii) Multiple messages placed within individual folders by the same End User restating the same point.
  • (viii) Chain letters of any kind.
  • (ix) Identical (or substantially similar) messages to multiple recipients advertising any product or service, expressing a political or other similar message, or any other type of unsolicited commercial message. This prohibition includes but is not limited to
    • a) Using Bestylish.com invitations to send messages to people who don’t know you or who are unlikely to recognize you as a known contact;
    • b) Using Bestylish.com to connect to people who don’t know you and then sending unsolicited promotional messages to those direct connections without their permission; and
    • c) Sending messages to distribution lists, newsgroup aliases, or group aliases.
  • The Opt-out Practice

• Access to Password Protected/Secure Areas
  
  Access to and use of password protected and/or secure areas of the Site is restricted to authorized End Users only. Unauthorized individuals attempting to access these areas of the Site may be subject to prosecution.
  
  
• Modifications and Notification of Changes
  
  BeStylish reserves the right to make changes to the Site, related policies and agreements, this T&C and the Privacy Policy at any time. If BeStylish makes a material modification to this T&C, it will notify you by: (i) sending an email to the address associated with your account. BeStylish is not responsible for your failure to receive an email due to the actions of your ISP or any email filtering service; therefore, you should add Bestylish.com to the list of domains approved to send you email (commonly known as your “white list”); and (ii) displaying a prominent announcement above the text of this T&C or the Privacy Policy, as appropriate, for thirty (30) days, with (i) and (ii) being deemed sufficient notification, of such changes. After notice of a modification to the T&C or the Privacy Policy has been posted for 30 days, the notice will be removed and a brief description of the modification and the date that it went into effect will be placed in the Historical Modifications section at the end of the T&C and Privacy Policy. End Users are prohibited from using any Marks for any purpose including, but not limited to use as meta-tags on other pages or sites on the World Wide Web without the written permission of BeStylish or such third party which may own the Marks. All information and content including any software programs available on or through the Site (“Content”) is protected by copyright. End Users are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any Content available on or through the Site for commercial or public purposes.
  
  
• Billing
  
  The price of our merchandise is inclusive of the VAT. The vat charged shall depend upon the destination where the order has to be shipped. The tax rate applied to the order will be the combined tax rate for both state and local tax rates in accordance with the address where the order is being shipped. BeStylish reserves the right to collect taxes for shipping charges wherever applicable.

  • a.) General Retail
    
    BeStylish has put no-hassle procedures in place to ensure that you can buy from us in confidence as well as return your purchase to us, hassle free. In case you are not happy with the purchased product or have found an issue in the quality, size or colour of the item, please call our customer care at 1800-4190300 or simply log into your account and place a return request.
    
    How to Return
    
    Return of Products will only be accepted if they are returned in their original packaging and within 100 days of purchase. Products returned must be unused, unworn, unwashed and undamaged by you.
    
    Returns of handbags will be accepted only if the “white security” tag is intact. Bags returned with tampered tags will not be accepted and refund will not be issued.
    If you should on the rare chance receive a bag with the “white security” tag already broken please report it to us immediately, either via email (with photographic proof) or call our toll free number 1800 419 0300.
    
    In addition, products must be returned inside their original box to avoid a re-stocking fee of Rs. 100.
    
    Please note that we do not accept returns on items valued at Rs. 300 or less. However, if we receive any such product, then BeStylish will not be liable to return the product to the customer. It will simply be disposed.
    
    Any product that fails QC (quality check) performed by beStylish.com will be returned to the customer only upon their request and will be nonrefundable. Please note that the cost of the return courier will be borne by the customer in this case.
    
    In the case of a manufacturing defect please send an email at care@bestylish.com along with digital photographs and our care team will look into the matter and assist you accordingly.
    
    Once you have received your purchase, should there be any discrepancy in your product, customers must report the issue to our care team within 24 hours of delivery, either by email or call us at 1800-4190300.
    
    Our reverse pick-up facility is currently only available in select locations, as it is dependent on the pincodes serviced by our various courier partners.
    
    Reverse pick-up in Delhi / Gurgaon / Faridabad ––
    These locations will be attempted by our own beStylish Van.Kindly note, beStylish will make only two (2) attempts for a reverse pick-up. If the consignee/customer is unavailable after two (2) failed attempts, the customer will be responsible to return the product to us at his/her own expense.
    
    Reverse pick-up from Pan-India locations –
    We will arrange for a return through our existing courier partners, and the same shall be picked up within 72 hours.
    
    Kindly note, our courier partner will make only one (1) attempt for a reverse pick up. If the consignee/customer is unavailable after one (1) failed attempt, the customer will be responsible to return the product to us at his/her own expense.
    
    No revere pickup service –
    If reverse pickup service is unavailable at your location through our couriers, then you will be requested to send us the product only through India Post. beStylish will either reimburse the shipping charges to you or alternatively provide you with a flat 10% discount on your next purchase. In cases where customers wish to have the shipping cost reimbursed, they must attach a copy of the receipt and AWB.
    
    Note: All packages given to any courier service for return should be well packed to avoid any theft in-transit. When you are returning the product yourself, we recommend you use a reputed courier service to send the package back to us.
    
    All return products must clearly mention the consignee address on the return Airway Bill, as given below -

  • b.) Goods sold at discount (“Sales Event”)
    
    A Product on Sale shall be available for a limited duration of time and such Products will be available at a discounted price.
    
    Any return/refund of any Products sold through Sales shall be subject to the availability of the Product as well as at our sole discretion. To return an item, the customer must write to us at care@Bestylish.com, a prompt response is assured to such mails. Alternatively, the customer may call at our customer care number 1800-4190300. Items and packaging must be unused, unworn, unwashed and undamaged by you. Goods will only be accepted if they are returned in their original packaging, including shoe boxes and the invoice to our address.
    Products must be returned inside their original box to avoid Rs.100 re-stocking fee.

     

     

• Refund Clause
  
  Refund will be made in the following way:

   

  • i. If the payment was by Credit Card or Net-Banking, we will refund the Credit Card or Net-Banking account.
  • ii. If the payment made was Cash on Delivery, we will send a cheque.

  Please allow 7-10 business days after receiving the product for any refund to appear in your credit card account. Please note that depending on your credit card company, it may take additional 2-10 business days after your credit is applied to your account.
  
  If you placed the order using COD, we shall dispatch a cheque within 7-10 business days.

  
  

  Cheques will be sent only to the billing address of the customer. The refund process will be initiated once we have received the product(s). Typically, refunds are processed in less than 10 (ten) working days but in case of payments by Cheque, it may take a few extra days for the cheque to be delivered to your billing address.
  
  

  In case of returns for COD orders delivered by the Post Office, beStylish will refund the money to a customer only after it has received the same from the Post Office.
  
  

  Please note: For all purchases made under a scheme, whether voucher, sale or promotion, refunds would only be in the form of store credit. No money will be refunded in these cases.
  
  

• Delivery & Shipping Charges
  
  BeStylish endeavours to deliver the Products to customers within 1-2 working days in major metro cities from the day the order is confirmed. However, the duration of delivery of Products can take from 7 to 10 working days depending on customer location. Delivery time to the end user is subject to factors beyond our control (“Force Majeure Event”) including unexpected travel delays from our courier partners and transporters due to weather conditions and strikes.

   

  In the event that beStylish cannot fulfill complete orders due to any reason (quality check rejection, unavailability of product), partial orders will be dispatched to customers by the company.

   

  In case the order is prepaid, customers will either be issued vouchers or refunded the money for the unfulfilled orders.

   

  In case the order is COD (Cash on Delivery), customers will be sent revised invoices charging them with only the fulfilled part of the order.

   

  Please note that Bestylish levies a shipping charge of Rs. 50 in case order amount is less than Rs.300. If order amount is Rs.300 or more then no shipping charges are levied.

   

  BeStylish will not be liable for any loss or expenses sustained by the End User arising from any delay in the delivery of the goods howsoever caused.

   

  BeStylish reserves the right to make delivery of the goods in installments. If the goods are to be delivered in installments, each delivery will constitute a separate contract. You may not treat the contract (as a whole) as repudiated if BeStylish fails to deliver any one or more of the installments or if you have a claim in respect of any one or more of the installments.

   

  In case Bestylish receives the product back in warehouse as undelivered return then we will inform customer via email/phone and if no revert received within five days to re-dispatch the shipment the order will be automatically cancelled. In the event you are not available to accept delivery on second attempt, BeStylish may at its discretion charge you for the additional shipping cost on the third attempt made. If you fail to take delivery of the goods, BeStylish may at its discretion charge you for the additional shipping cost. BeStylish will not be liable for any loss or expenses sustained by the Buyer arising from any delay in the delivery of the goods howsoever caused.

   

  The following states in the North-East are not being serviced yet – Meghalaya, Sikkim, Tripura, Mizoram and Nagaland. Delivery will take place to select cities in Assam, Manipur and Andaman & Nicobar Islands. Customers are requested to check with Bestylish Customer Care for more details.
  
  Cash on Delivery: You agree, understand and confirm that for the Cash on Delivery (“COD”) details provided by you for availing of services on BeStylish will be correct and accurate. You further agree and undertake to provide the correct and Responsible persons Name, valid Address and Contact details to BeStylish at the time of order. BeStylish will not use or share this information with any third party unless authorised by you, or required for fraud verifications or by law, regulation or court order. The customer will be liable for his order as soon as the order has been dispatched out of warehouse and any cash handling charges levied by BeStylish.The customer will be liable for his order as soon as the order has been dispatched out of warehouse and any COD charges levied by BeStylish.

   

  Cash Handling Charges:  While we will endeavour to reduce these charges in the future, we currently have to pay a cash handling charge to our shipping partners in order to process COD transactions.  
  
  
  

  There is a flat 'cash handling' charge of Rs 100 that is imposed on any COD consignment.
  
  

  Additionally, we do not offer any return on items below Rs 300 (nett of all discounts, promotions, discount vouchers, etc.).
  
  

  Please note, there is no COD facility above Rs10,000.
  
  We are always looking for ways to save you money and promise to reduce or eliminate these costs in the future.
  
  

  COD orders are processed only after successful confirmation call is placed by Bestylish. Please note that however Bestylish will not be able to contact you in case your number is on DNC list generated by TRAI. In this case customer has to contact us at 1800-4190300 and confirm the order. Orders not confirmed within 48 hours will be automatically cancelled.

  
  
  
• Survival of Terms after Agreement Ends
  
  Notwithstanding any other provisions of this T&C, or any general legal principles to the contrary, any provision of this T&C that imposes or contemplates continuing obligations on a party will survive the expiration or termination of this T&C.

  36. Miscellaneous
  
  If any of these conditions are deemed invalid, void, or for any reason unenforceable, the parties agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the unenforceable condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition. From time to time BeStylish may offer special promotional offers which may or may not apply to your BeStylish account. To avail of such promotional offers, you agree to be bound by any additional terms and conditions for these special offers which are laid down by BeStylish. This T&C and the relationship between you and BeStylish will be governed by the laws as applicable in India. Any dispute(s) arising out of this T&C will be handled in the competent courts of Delhi, India. The failure of BeStylish to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. BeStylish does not guarantee it will take action against all breaches of this T&C. Except as otherwise, expressly provided in this T&C, there shall be no third-party beneficiaries to this T&C. This T&C constitutes the entire agreement between you and BeStylish and governs your use of the Site, superseding any prior agreements between you and BeStylish with respect to the Site.
